Post subject:  Deviantart/Copyright problems?? Plz help me!
I don't get it! I'm fairly new ar DA, so I've no idea what's going on... :annoyed2:

I uploaded several stuff of my Fanart: Movie Wallpapers and Blends (It was Star Wars, LotR and Pride and Prejudice).

And I got this message:

I just don't get it! How can you make Digital Fanart without using pictures from actors or movies? Why do they have categories that say "Fanart-Movies" and stuff if you're not allowed to upload things?
Everything I submitted was completely my own art, but everybody has to use pictures or screencaps for Digital Art...?! :confused:

I don't know what to do. Has anybody had problems like this before? Please help me. :confused2:

Well I'm not sure....but it think most people make their own kind of 3-D computer art out of movie stuff.....so they don't use any copywrited images, but make their own likeness of them?...I'm not sure if that's correct or not though. :confused: Sorry I can't be more help.

I think it's pretty much what Elven Archer said... you've got to make a likeness of the characters/movies/etc that you're doing, like drawing, airbrushing, etc. Using actual photographs is copyright violation. I know it seems unfair, but dA are right in that respect.

So... in other words DA will not accept the type of stuff people post in this section? They have to be your photography, your drawings... etc? Wow, I never knew that. Not much point me getting a DA account then.

^ wil not really? I uploaded the batman blend I did, Kate Beckinsale and Selene and a star wars blend to DA and I didn' get that message..what do you blends look like?

^ That's because you haven't been caught. FF would have uploaded her graphics recently, which means that the dA staff would have noticed it a lot easier. Because you probably uploaded your graphics a while ago, dA probably didn't notice.

Like EA said, you have to create the pictures of the characters, scenes etc. So making a banner with pictures or stills from LotR and uploading it to dA is not allowed. If you scan through the galleries on there, there are only computer generated graphics(CGG), so the stuff that the graphic makers on here are so well known for would not be allowed to upload their stuff.

no i dont htink so...ive seen other galleries that hav estuff like that.. Ive seen your gallery you have blends of jake on there

Hmm, I have to diagree here. If you search, for example, "LotR wallpaper", you get a bunch of the normal blend stuff, just like LOTRfreak said. Perhaps those people just weren't caught, but it's really a lot! :confused:


Thank you anyway. I won't take the risk of uploading such stuff anymore, but it's kind of confusing to see how many people break the rules. :confused2:

I know I do, but that's because I haven't been caught. Noticed when I uploaded those - well over a year ago, there is no chance unless by pure dumb luck that the dA staff could find them. It doesn't matter to me anyway, I don't dA anymore :P

FF - I know that there a hundreds, maybe even thousands, of graphics just like yours that are on dA at the moment - and the fact that there's so many, of course it seems unfair that you should be singled out. But even though you can type in "LotR wallpaper" and find plenty of things, they don't have them by category. What I mean is, whatever category these wallpapers have been placed in, they shouldn't be there. dA are right in saying that it is plagiarism - what we all love doing on here, and other fanworks such as fanfictions are breaking god knows how many laws, but because of how big the "fanchise" thing has grown, there's not a great deal anyone could do about it, and you'll rarely find an accusation of plagiarism unless it is on a popular website, which you had the unfortunate experience of having. It's annoying, I know I would just be as annoyed as you about it, but you're right by not risking uploading them again. I've heard that annoying the dA staff is a bad idea. ;)

I had this problem, too. I got slapped on the hand for the very first deviation I posted on there, in fact (that "The Battle of Evermore" wallpaper I posted a while back) :confused2:! To this day, I can't figure out exactly what elements of it violated copyright laws- the pictures I used, or the lyrics to the Led Zeppelin song of the same name that were the centerpiece of it (even though I clearly stated the text was from said song by said artist :annoyed2:) :confused:. After that, I didn't post a single thing, desktops or otherwise, for a while. Once I began building up a collection of things that likely wouldn't fit in that category (i.e. drawings, poems, and most recently, photographs), I started posting again. Basically what I'm suggesting is continue doing what you're doing (steering away from posting stuff like wallpapers). It is rather annoying and doesn't exactly make sense, since a good portion of the wallpapers in the movie, TV, Music, etc. categories could conceivably be defined as "copyright violations", but it's the best thing to do :yes:.

Have you tried to put credits in the description? p.0
I mean, a link to where you got the pictures, textures, brushes...

All of my icons and such got deleted like that before I did, so it's worth a try ;)
